Please read these Terms of Service ("Terms") carefully before using our website, text messaging program, or Services. By accessing or using Grrowth's Services, you agree to be bound by these Terms. If you do not agree, do not use our Services. Grrowth is operated by Black Dash LLC.

1. Our Services

Grrowth builds and provides "AI Employee" solutions for small businesses, which may include:

• AI-powered website widgets
• AI Receptionist (appointment booking and inquiry handling)
• AI Sales Assistant (follow-ups, text campaigns, lead nurturing)
• AI Review Assistant (review requests and reputation management)
• Website design and setup, where applicable

(collectively, the "Services")

2. SMS / Text Messaging Terms

These SMS terms apply to everyone who opts in to receive text messages from Grrowth.

• Program description. Grrowth sends conversational and notification text messages related to your inquiry, account, or appointments — including appointment confirmations and reminders, replies to questions, quote and service follow-ups, review requests, and, where separately consented to, occasional promotional offers.
• Consent. You will only receive text messages from us if you provided your mobile number and express consent — through a form on our website containing an SMS consent disclosure, verbally or in writing to a Grrowth representative, by texting us first, or through one of our business clients' intake or booking flows. Consent to receive marketing text messages is never a condition of purchasing any goods or services.
• Opt-out. Reply STOP to any message to be removed from further texts. You will receive one confirmation message and no further messages unless you opt in again.
• Help. Reply HELP for assistance, or contact us at hello@grrowth.co or 615-437-7389.
• Message frequency. Message frequency varies based on your interactions with us.
• Cost. Message and data rates may apply. Grrowth does not charge for text messages; your mobile carrier's standard rates apply.
• Carriers. Supported carriers include major U.S. wireless carriers. Carriers are not liable for delayed or undelivered messages. Message delivery is subject to carrier and network conditions.
• Privacy. Mobile numbers and SMS consent data are handled as described in our Privacy Policy, and are never shared with third parties or affiliates for marketing purposes.

3. Setup and Free Build Offer

From time to time, Grrowth may offer to build and set up a client's AI Employee (and, where applicable, a website) at no upfront cost as part of a promotional offer. This offer is at Grrowth's discretion, may be limited to a certain number of businesses, and may be modified or discontinued at any time.

If a client chooses to continue using their AI Employee after the initial setup, they agree to enroll in an ongoing monthly subscription plan, as described in Section 4.

4. Fees and Payment

• Continued use of an AI Employee after setup requires an active monthly subscription.
• Monthly pricing will be communicated to the client prior to enrollment and may vary based on the specific product(s) and features selected.
• Fees are billed on a recurring monthly basis unless otherwise agreed in writing.
• Clients may cancel their subscription at any time in accordance with Section 8 (Cancellation).
• Grrowth reserves the right to change pricing with reasonable advance notice to active clients.

5. Client Responsibilities

Clients using Grrowth's Services agree to:

• Provide accurate business information necessary to build and operate their AI Employee
• Obtain and maintain valid express consent from their own customers before any text messages are sent on their behalf, and honor all opt-out requests
• Use the Services in compliance with applicable laws and industry rules, including the Telephone Consumer Protection Act (TCPA), CTIA messaging guidelines, and applicable consumer protection and data privacy laws
• Maintain their own privacy notices and messaging disclosures for their customers, where required
• Not use the Services for unlawful, deceptive, or harmful purposes, or to send prohibited message content (including messages relating to illegal substances, hate speech, or fraudulent offers)

6. AI Employee Performance

Grrowth's AI Employee products are designed to assist with tasks such as answering inquiries, booking appointments, following up with leads, and requesting reviews. While we work to make these tools accurate and reliable:

• AI-generated responses may not always be perfect and should be monitored by the client
• Grrowth does not guarantee specific business outcomes, including but not limited to revenue increases, lead volume, or customer conversion rates
• Clients are responsible for reviewing and confirming that automated communications sent on their behalf are appropriate for their business

7. Intellectual Property

• Grrowth retains ownership of the underlying technology, software, and systems used to power the AI Employee products.
• Websites and AI Employee configurations built for a client become the client's to use for their business, subject to an active subscription (where applicable) and these Terms.
• Clients retain ownership of their own business content, branding, and customer data.

8. Cancellation

Clients may cancel their monthly subscription at any time by providing notice to Grrowth. Upon cancellation:

• The AI Employee and/or associated features may be deactivated
• No further monthly fees will be charged going forward
• Grrowth is not obligated to refund fees already paid for the current billing period, unless otherwise agreed

9. Limitation of Liability

To the fullest extent permitted by law, Grrowth shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of or inability to use our Services, including but not limited to lost profits, lost data, delayed or undelivered messages, or business interruption, even if advised of the possibility of such damages.

10. Disclaimer of Warranties

Our Services are provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Termination

Grrowth reserves the right to suspend or terminate access to the Services for any client who violates these Terms, engages in unlawful activity, sends messages without valid consent, or otherwise misuses the Services.

12. Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised effective date. Continued use of our Services after changes take effect constitutes acceptance of the revised Terms.

13. Governing Law

These Terms shall be governed by the laws of the State of Tennessee, USA, without regard to its conflict of law principles.
